Welcome to HoneyPaws. These Terms of Service (“Terms”) govern your access to and use of the HoneyPaws website, mobile application, and related services (collectively, the “Service”).

Please read these Terms carefully. By accessing or using HoneyPaws, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

 
1. Who We Are

In these Terms, “HoneyPaws”, “we”, “us”, and “our” refer to HoneyPaws SNC.

 
2. Eligibility

You may use the Service only if:

• you are legally capable of entering into a binding agreement under applicable law;
• you comply with these Terms and all applicable laws and regulations;
• you are at least 18 years old, or, if younger, you use the Service under the supervision and responsibility of a parent or legal guardian where permitted by law.

By using HoneyPaws, you represent and warrant that you meet these requirements.

 
3. The Service

HoneyPaws is a platform designed for dog owners and dog lovers. Depending on the features available at a given time, the Service may allow users to:

• create profiles for themselves and their dogs;
• share content, posts, images, and other materials;
• discover dog-friendly places and services;
• check in to locations such as dog parks;
• explore third-party offers, listings, or booking opportunities;
• interact with other users and community features.

Some features may be added, modified, limited, or removed over time.

4. User Accounts

To access certain features, you may need to create an account.

You agree to:

• provide accurate, current, and complete information;
• keep your login credentials confidential;
• be responsible for all activity under your account;
• promptly notify us if you believe your account has been accessed without authorization.

We reserve the right to suspend or terminate accounts that contain false information, impersonate others, or violate these Terms.

5. Dog Profiles and User Content

You may be able to submit content to the Service, including text, images, profile information, location-related content, reviews, comments, and content relating to your dog (“User Content”).

You remain the owner of your User Content. However, by posting or uploading User Content to HoneyPaws, you grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, display, adapt, distribute, and make available that User Content as necessary to operate, improve, promote, and provide the Service.

You represent and warrant that:

• you own the User Content you submit, or you have all necessary rights to submit it;
• your User Content does not violate any law or third-party rights;
• your User Content is accurate to the best of your knowledge;
• any content relating to animals does not depict or promote abuse, cruelty, neglect, or illegal activity.

6. Acceptable Use

You agree not to use HoneyPaws to:

• violate any applicable law or regulation;
• harass, threaten, abuse, or harm others;
• post defamatory, fraudulent, misleading, obscene, or hateful content;
• impersonate any person or entity;
• upload malware, viruses, or harmful code;
• interfere with the functioning or security of the Service;
• scrape, copy, or extract data from the Service without authorization;
• use the Service for spam, scams, or unauthorized advertising;
• promote animal abuse, illegal breeding practices, unsafe conduct, or illegal transactions;
• infringe intellectual property or privacy rights of others.

You must also comply with our Community Guidelines, which form an important part of the rules governing use of the platform.

7. Community Guidelines

HoneyPaws maintains separate Community Guidelines that explain expected behavior on the platform and what content or conduct may lead to content removal, account restriction, or suspension.

By using the Service, you agree to comply with those Community Guidelines in addition to these Terms. If there is a conflict between the Community Guidelines and these Terms, these Terms will prevail to the extent of the conflict.

8. Content Moderation and Enforcement

We reserve the right, but do not have the obligation, to monitor, review, remove, restrict, or disable access to any User Content or account if we reasonably believe that it violates these Terms, the Community Guidelines, applicable law, or the safety and integrity of the Service.

We may take actions including:

• removing content;
• issuing warnings;
• limiting visibility or functionality;
• suspending or terminating accounts;
• reporting unlawful conduct to competent authorities where appropriate.

9. Third-Party Services and Links

HoneyPaws may include links to, integrations with, or references to third-party services, websites, products, or platforms, including booking and travel services, maps, social platforms, and other external providers.

For example, certain accommodation or booking-related features may redirect you to third-party platforms to complete a reservation or transaction.

We do not control and are not responsible for:

• third-party websites or services;
• the availability, accuracy, pricing, legality, or quality of third-party offers;
• third-party terms, privacy policies, or business practices;
• transactions entered into between you and any third party.

Your use of third-party services is governed by the terms and policies of those third parties.

10. No Guarantee of Listings, Availability, or Suitability

HoneyPaws may display information about dog-friendly places, parks, businesses, accommodations, or other services. Such information may come from users, partners, third parties, or public sources.

We do not guarantee that any place, service, or listing is:

• accurate,
• available,
• safe,
• appropriate for your dog,
• compliant with local laws,
• or continuously dog-friendly.

You are solely responsible for verifying the suitability of any place, booking, service, or activity for yourself and your dog.

11. Health, Safety, and Animal Responsibility

HoneyPaws is an informational and community platform. It does not provide veterinary, medical, behavioral, legal, or emergency advice.

You remain fully responsible for:

• your dog’s supervision, health, and behavior;
• compliance with leash laws and local rules;
• evaluating whether a location, product, or activity is safe and appropriate;
• interactions with other users, animals, businesses, and third parties.

Never rely on HoneyPaws as a substitute for veterinary advice, emergency assistance, or professional judgment.

12. Intellectual Property

The Service, including its design, branding, logos, software, graphics, text, and other content provided by HoneyPaws, is owned by or licensed to HoneyPaws and is protected by applicable intellectual property laws.

Except as expressly permitted by us in writing, you may not:

• copy,
• modify,
• distribute,
• sell,
• reverse engineer,
• or exploit

any part of the Service or HoneyPaws content.

“HoneyPaws” and related names, logos, and branding may not be used without prior written permission.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, store, and protect personal data.

By using HoneyPaws, you acknowledge that you have read our Privacy Policy.

14. Feedback

If you provide us with suggestions, ideas, feedback, or recommendations regarding the Service, you agree that we may use them without restriction or compensation to you.

15. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis.

HoneyPaws makes no warranties or representations, express or implied, regarding the Service, including any warranties of:

• merchantability,
• fitness for a particular purpose,
• non-infringement,
• availability,
• security,
• reliability,
• accuracy,
• or error-free operation.

We do not guarantee that the Service will always be uninterrupted, secure, or free of bugs or harmful components.

16. Limitation of Liability

To the maximum extent permitted by applicable law, HoneyPaws and its founders, partners, officers, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, business opportunity, or other intangible losses arising out of or related to:

• your use of or inability to use the Service;
• your interactions with other users or third parties;
• third-party services, bookings, listings, products, or websites;
• unauthorized access to your account or data;
• content posted by users or third parties;
• any conduct, injury, damage, loss, or dispute involving a dog, person, business, or third party.

To the extent permitted by law, our total liability for any claim arising out of or relating to the Service shall not exceed the greater of:

the amount you paid to HoneyPaws, if any, in the 12 months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law.

17. Indemnification

You agree to indemnify and hold harmless HoneyPaws and its founders, partners, affiliates, officers, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to:

• your use of the Service;
• your User Content;
• your violation of these Terms, the Community Guidelines, or applicable law;
• your infringement of any rights of a third party;
• your dog, including damage, injury, or incidents connected to your dog where permitted by law.

18. Suspension and Termination

We may suspend, restrict, or terminate your access to the Service at any time, with or without notice, if:

• you violate these Terms or the Community Guidelines;
• we believe your conduct creates legal risk, harm, or disruption;
• required by law or by a competent authority;
• we decide to discontinue part or all of the Service.

You may stop using the Service at any time.

Provisions that by their nature should survive termination shall survive, including those concerning intellectual property, disclaimers, limitation of liability, indemnity, and governing law.

19. Changes to the Service

We reserve the right to modify, suspend, or discontinue all or part of the Service at any time, temporarily or permanently, with or without notice.

We are not liable for any modification, suspension, or discontinuation of the Service.

20. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may provide notice through the Service, by email, or by other reasonable means.

The updated Terms will become effective when posted, unless otherwise stated. Your continued use of HoneyPaws after the effective date of updated Terms constitutes acceptance of the updated Terms.

21. Governing Law

These Terms are governed by the laws of Switzerland, excluding conflict of law principles, unless mandatory law provides otherwise.

22. Jurisdiction

Any dispute arising out of or in connection with these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the competent courts of Canton Ticino, Switzerland, unless mandatory law provides otherwise.

23. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

24. No Waiver

Any failure by HoneyPaws to enforce a provision of these Terms shall not constitute a waiver of that provision or any other right.
